  Constitution & By-Laws  
  JUNE 2024 TO JUNE 2025  
         
  ARTICLE 1 NAME    
         
  01.01 This ASSOCIATION shall be known as THE HAMILTON FIRE DEPARTMENT PENSIONER’S ASSOCIATION.    
         
  01.02 The objectives of this ASSOCIATION (hereby known as “The Group”, shall be to improve the lives of retired fire fighters and their families; and, to promote and advocate benefits, pensions and the welfare of the MEMBERS.    
         
  ARTICLE 2 MEMBERSHIP    
         
  02.01 The MEMBERSHIP shall be comprised of retired full-time members and members with full-time prior service with the Hamilton, Stoney Creek, Ancaster, Flamborough and Dundas Fire Departments    
         
  ARTICLE 3 MEMBERSHIP DUES    
         
  03.01 All members, in-good-standing, shall receive all notifications and benefits.    
         
  03.02 All members in good standing shall pay yearly dues of ten dollars ($10.00) to The ASSOCIATION by March 31 of each year.    
         
  03.02.01 Any donation to THE GROUP shall be clearly identified as such or it will be assumed that it was intended as a prepayment of annual dues.    
         
  03.03.01 Complimentary Membership shall be extended to HFD Members that have retired between April 1st of the current HFDPA fiscal year and March 31st at the end of the current fiscal year.    
         
  ARTICLE 4 MEETINGS    
         
  04.01 Meetings will be held on the second Tuesday of the following Months: March, June, September and December.    
         
  04.02 A quorum for a GENERAL or a SPECIAL MEETING shall consist of seven (7) MEMBERS (in good standing) plus the President or his EXECUTIVE DESIGNATE and one (1) EXECUTIVE MEMBER, for a total of nine (9) MEMBERS.    
         
  04.03 A Special Meeting shall be called at the request of fifteen (15) members to THE SECRETARY, in writing, regarding the business to be conducted.    
         
    The said meeting shall be held within fourteen (14) days.    
         
  04.04 A sign in book shall be used to ensure that all members sign in and can be accounted for at the meeting.    
         
  ARTICLE 5 OFFICERS    
         
  05.01 The affairs of THE GROUP shall be managed by a BOARD OF DIRECTORS, consisting of the following: PRESIDENT, SECRETARY, and TREASURER.    
         
  ARTICLE 6 ELECTION OF OFFICERS    
         
  06.01 Nominations for the positions of President, Treasurer, Secretary, shall be made at the March meeting.    
         
    The election of OFFICERS shall take place in the month of June    
         
  06.02 A member who is unable to attend said meeting shall notify the Secretary in writing, by email or Canada Post, of his intention to be nominated for a position.    
         
  06.02.01 A member (nominee), in good standing who is unable to attend the March meeting shall notify the Secretary in writing by email or Canada Post, of his or her intention, if nominated to accept and stand for the position.    
         
  06.02.02 A member (sic-nominator), in good standing who is unable to attend the March meeting shall notify the Secretary in writing by email or Canada Post of his or her intention to nominate a member in good standing to a position and, specify the position.    
         
  06.03 The election of all officers shall be conducted by secret ballot of all members present.    
         
  06.04 The President shall appoint a Returning Officer to conduct elections and account for all ballots cast.    
         
  06.05 In the event of a tie-vote, the Returning Officer shall cast the deciding ballot.    
         
  ARTICLE 7 FUNDS    
         
  07.01 No funds shall be used for any purpose other than the operation of THE GROUP, (stamps, papers, repairs, etc.) with exception of the passing of a retired fire fighter (Hamilton). A donation in memory of said pensioner to a charity, not to exceed Fifty ($50.00) dollars.    
         
  ARTICLE 8 AMMENDMENTS TO THE CONSTITUTION & BY-LAWS    
         
  08.01 Any GENERAL MEETING may amend, repeal or re-enact the CONSTITUTION & BY-LAWS of THE GROUP by a two-thirds (2/3) vote of THE MEMBERS there present. Subject however, to DUE NOTICE having been given as here-in-after set forward    
         
  08.02 Notice of any proposed changes or amendments to THE CONSTITUTION AND BY-LAWS shall be given in writing to THE SECRETARY by the month of March and voted on at the June meeting.    
         
  08.03 All proposed changes to be in the March Meeting letter.    
         
  ARTICLE 9 ORDER OF BUSINESS    
         
  09.01
  1. Calling the meeting to order;
  2. Reading of the last meeting minutes;
  3. Reading of communications & correspondence;
  4. Treasurer's Report;
  5. Reports of Committees;
  6. Unfinished business;
  7. New Business;
  8. Good & Welfare;
  9. Adjournment.
   
   

 

   
  ARTICLE 10 LIFETIME MEMBERSHIP    
         
  10.01 A Lifetime Member shall be a member-in-good standing,who has been nominated by a member and voted on by qualified members present at any regular general meeting, by a simple majority vote. Lifetime Members shall retain all privileges of Active or Regular Members.    
         
  10.02 An “Associate Honourary Member” may be a person that does not qualify for membership described by Article 2.01 but is recognized for a meritorious public service or for notable or meritorious service to The Group. They shall not be required to pay dues.    
         
    Associate Honourary Members will not be eligible to vote for any Association matters. Associate Honourary Members shall be passive at Association meetings except for Good and Welfare announcements.    
         
  ARTICLE 11 POLITICS    
         
  11.01 This ORGANIZATION shall not donate any monies to any municipal, provincial or federal parties.    
         
  NOTE: A vote on the inplimentation of Roberts Rules of Order has been tabelled until the September 2022 quarterly meeting - defeated - September 13th
